Terms & Conditions

These Terms & Conditions apply to quotes, booking requests and chauffeur services supplied by Bayside Chauffeured Cars Pty Ltd (ABN 22 680 102 541). By submitting a booking request, accepting a quote or using our services, you agree to these terms.

2. Booking Requests and Confirmation

Submitting an online form does not automatically confirm a journey. It sends us a booking request.

A booking is confirmed only when we provide written confirmation by email, SMS, WhatsApp or another agreed method. Confirmation may include a booking reference, itinerary, vehicle category, price and payment requirements.

All bookings are subject to vehicle and chauffeur availability. You are responsible for checking the confirmation and notifying us promptly of any incorrect information.

3. Quotes and Prices

All consumer prices are quoted in Australian dollars and include GST where applicable.

A quote applies only to the itinerary, date, time, passenger number, luggage, vehicle category and services stated in the quote. Known mandatory charges will be included or clearly identified before confirmation.

Additional reasonable charges may apply when requested or caused by changes including:

  • Additional stops or material route changes.
  • Waiting beyond the included waiting period.
  • Extra parking, airport access or toll costs not reasonably known when quoted.
  • Vehicle upgrades, child seats or other requested equipment.
  • Cleaning or repair required because of passenger conduct.

We will explain any material price change and seek your approval where reasonably possible. If you do not accept a material change made by us before confirmation, you may cancel without penalty.

4. Payment

Payment requirements and due dates will be stated in your quote or booking confirmation. A booking may remain unconfirmed until any required deposit or payment is received.

Deposits form part of the total booking price. Any payment processing surcharge will be disclosed before payment and will not exceed the amount permitted by law.

Corporate accounts are subject to approval and any separately agreed payment terms.

5. Changes Requested by the Customer

Changes to the pickup time, route, passenger number, vehicle or other booking details are subject to availability and may change the price.

Please request changes as early as possible. If we cannot accommodate a requested change, the original confirmed booking remains in place unless cancelled under the cancellation policy below.

6. Cancellation Policy

Cancellation notice should be provided by telephone, email or WhatsApp and takes effect when received by us.

Standard Airport and Corporate Transfers

  • 24 hours or more before pickup: no cancellation fee and a full refund of amounts paid.
  • Between 6 and 24 hours before pickup: a cancellation fee of up to 50% of the booking price.
  • Less than 6 hours before pickup or a no-show: a cancellation fee of up to 100% of the booking price.

Weddings, Events, Sprinter, Large-Group and Multi-Vehicle Bookings

  • 7 days or more before pickup: no cancellation fee, except for reasonable third-party or non-recoverable costs already incurred and disclosed to you.
  • Between 48 hours and 7 days before pickup: a cancellation fee of up to 50% of the booking price.
  • Less than 48 hours before pickup or a no-show: a cancellation fee of up to 100% of the booking price.

These percentages are maximum amounts. Any cancellation fee will be limited to our reasonable costs and losses arising from the cancellation, taking into account whether the vehicle or chauffeur can be rebooked.

Approved refunds will normally be processed to the original payment method within 5–10 business days. Financial institution processing times may vary.

This cancellation policy does not limit any right to cancel or obtain a remedy under the Australian Consumer Law.

7. Airport Transfers and Flight Changes

You must provide the correct flight number, arrival date and passenger contact details. Flight tracking is provided as an assistance and depends on information supplied by airlines and third-party systems.

Where accurate flight details have been provided, we will make reasonable efforts to adjust pickup timing for ordinary flight delays. A flight delay by itself will not be treated as a customer cancellation.

If a flight is cancelled, contact us as soon as possible. We will prioritise moving the booking to a new flight or date without a change fee, subject to availability. Reasonable costs already incurred and unable to be recovered may still apply and will be explained.

Airport waiting time included in the booking will be stated in the quote or confirmation. Additional waiting beyond that period may be charged at the rate disclosed in the confirmation.

8. Waiting Time and No-Shows

You must be ready at the agreed pickup location and time. If you cannot locate your chauffeur, contact us before leaving the pickup location or arranging alternative transport.

A booking may be treated as a no-show when the passenger is not present after the included waiting period and we have made reasonable attempts to contact the passenger using the details provided.

Additional waiting time caused by passenger delay may be charged in reasonable increments at the rate disclosed in the booking confirmation.

9. Passengers, Children and Luggage

You must provide accurate passenger and luggage numbers so that we can allocate a suitable vehicle.

Child seats, accessibility requirements and special equipment must be requested before confirmation. Availability is not guaranteed unless included in the written confirmation.

Passengers must use seatbelts and comply with lawful instructions from the chauffeur. The responsible adult remains responsible for supervising children throughout the journey.

We may refuse luggage or items that are unsafe, illegal, excessively heavy or cannot be carried within the vehicle’s lawful capacity.

10. Vehicles and Substitution

Vehicle photographs and model descriptions are representative of the relevant category. A specific make, model or colour is not guaranteed unless expressly confirmed in writing.

If the confirmed vehicle becomes unavailable, we may provide an equivalent or higher-category vehicle at no additional charge. If only a lower-category vehicle is available, we will offer an appropriate price adjustment or allow cancellation without penalty.

11. Passenger Conduct, Cleaning and Damage

Smoking, vaping, illegal substances, abusive behaviour and unsafe conduct are not permitted in our vehicles.

A chauffeur may refuse to commence or may end a journey where conduct is unlawful, threatening, abusive or creates a safety risk. Any charge will be limited to services already provided and reasonable costs or losses incurred, subject to applicable law.

The person making the booking is responsible for reasonable cleaning, repair or replacement costs caused by passengers beyond ordinary wear and tear. We will provide reasonable evidence or an itemised explanation of any charge.

12. Delays and Events Outside Our Control

We plan journeys using available traffic and travel information, but delays may occur because of traffic, accidents, road closures, severe weather, airline changes, government action or other events outside reasonable control.

We will take reasonable steps to notify you and provide an alternative where possible. Customers should allow appropriate travel time for flights, appointments and important events.

If we cannot provide a paid service and no acceptable alternative can be arranged, we will provide the refund or other remedy required by applicable law.

13. Lost Property

Please check the vehicle before leaving. We will make reasonable efforts to locate and return lost property but cannot guarantee recovery.

Reasonable postage, delivery or chauffeur travel costs may apply when returning an item and will be agreed before delivery.

14. Australian Consumer Law

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law, including that services will be provided with due care and skill and within a reasonable time where no time is agreed.

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot legally be excluded. Any limitation of liability in these terms applies only to the extent permitted by law.

15. Privacy

Personal information is handled in accordance with our Privacy Policy.

16. Complaints and Disputes

If you have a concern, please contact us first so we can investigate and try to resolve it promptly.

If a consumer dispute cannot be resolved directly, you may seek assistance from Consumer Affairs Victoria or another appropriate dispute-resolution body.

17. Changes to These Terms

We may update these terms from time to time. Updated terms apply to bookings made after publication. A confirmed booking remains subject to the terms provided or available when that booking was confirmed, unless both parties agree otherwise.

18. Governing Law

These terms are governed by the laws of Victoria, Australia. The parties submit to the courts and tribunals having jurisdiction in Victoria, subject to any rights that cannot be excluded by law.
